EFCC Drops Case Against Yahaya Bello At The Appeal Court
The EFCC has submitted a request to the Court of Appeal in Abuja to withdraw the appeal it had previously filed to overturn the interim injunction preventing the arrest of former Governor Yahaya Bello of Kogi State for trial.
According to DailyTrust, in its notice of discontinuance, dated April 22, the anti-graft agency stated that it decided to terminate further proceedings on the appeal because the initial order made by a Kogi State High Court in favor of the former governor is no longer applicable.
Additionally, the Commission acknowledged that the appeal was filed outside the allowed time frame according to the law.
The EFCC's filing before the appellate court stated that it intends to wholly withdraw the appeal against the respondent, citing the fact that the application filed by the appellant was overtaken by the decision of the same high court on April 17, 2024.
The court had issued ex parte orders on February 9, 2024, which were meant to last until the hearing and determination of the originating motion on notice, which was ultimately decided on April 17, 2024.
Furthermore, the notice of appeal was filed out of time, and the EFCC requested that the appeal be struck out for being filed out of time and incompetent.
It is worth noting that the former governor had sought the intervention of the Kogi State High Court to protect his fundamental rights and prevent his arrest.
The court, in a ruling on February 9, issued an interim order restraining the EFCC from inviting, arresting, or prosecuting the applicant until the matter is resolved.
